THE REGULATORY REFORM
(Fire Safety) ORDER 2004
Are you and your businesses ready for the introduction of the Regulatory
Reform (Fire Safety) Order 2004 which is to be introduced in April 2006?
This will replace the 1971 Fire Precaution Act, 1997/99 Fire Precautions
(Workplace) Regulations and 76 other linked regulations.
What this means to you!
These changes will affect all employers and will start a new fire safety
regime that will push forward the principles of Fire Risk Management.
The Regulatory Reform Act 2001 will cover virtually all premises in England and Wales to which the public has access. The only exception will be single private dwellings.
The proposed Order will form a fire safety regime based on the need for an employer or a responsible person to assess the risk from fire. However, unlike the workplace regulations 1997, the new order will seek to safeguard all occupants of the buildings and people in the vicinity of the building, not just employees. The responsible person will still be the employer, and when there is not one, it will be the person who is responsible for the activity that might give rise to a risk to those present.
Under the proposed new regime, employers and/or a responsible person, would be required to -
- Assess the risk from fire
- Take all practical steps to remove or reduce the risk
- Meet specific requirements, such as the provision of means of escape and fire fighting equipment as appropriate
- Take reasonable and practical
measures to mitigate against the spread of fire
Enforcement
The proposed order places the onus on the employers to manage the Fire Risk in their workplaces. It will require the fire authority to inspect premises to ensure that the fire precautions in place are adequate. In particular, the Fire Authority will have to implement and maintain and enforcement programme which clearly explains how they will determine the frequency of inspections.
